Thank you for joining the Torture Prevention Learning Village.

Below we have outlined our Terms of Service that help all of us stay protected and in control.

When we say “we”, “our”, or “us” in this document, we are referring to the Association for the Prevention of Torture. We are a small non-for-profit organisation based in Geneva, Switzerland, which developed the Torture Prevention Learning Village experience and content.

When we say “Services”, we mean any product, website or application created and maintained by the Association for the Prevention of Torture. That includes any instance of the Torture Prevention Village, whether delivered within a web browser, desktop application, mobile application, or any other format.

We may update these Terms of Service in the future. Usually, the changes will be to clarify some of these terms or add new ones as we expand the product. Whenever we make a significant change to our policies, we will share that with you via email.

When you use our Services, now or in the future, you are agreeing to the latest Terms of Service. This is true for any of our existing and future products and all features that we add to our Services over time. There may be times where we do not exercise or enforce any right or provision of the Terms of Service; in doing so, we are not waiving that right or provision. These terms do contain a limitation of our liability. If you abuse or violate any of the terms, we reserve the right to terminate your account. We will be open and transparent in this communication and try to resolve the situation beforehand.

Account Terms
  1. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage due to your failure to comply with this security obligation.
  2. You are responsible for all activity that occurs under your account.
  3. You must be a real human being. Accounts registered by “bots” or using other automated methods are not permitted and are subject to immediate termination.
Termination
  1. We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time. Suspension means you and any other users on your account will not be able to access the account or any content in the account. Termination will furthermore result in the deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. We also reserve the right to refuse the use of the Services to anyone for any reason at any time. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any of our employee, officer, or other user will result in immediate account termination.

Uptime, Security and Privacy
  1. Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis. We do not offer service-level agreements for our Services.
  2. We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public Internet. There are some edge cases where we may send your data through our network unencrypted.
  3. When you use our Services, you entrust us with your data. You agree that we may process your data as described in our Privacy Policy and for no other purpose.
Copyright and Content Ownership
  1. The names, look and feel, and content of the Services are copyright© to the APT. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, visual design elements, as well as content, without express written permission from the APT. You must request permission to use the APT’s logo or any Service logos for promotional purposes. Please email us requests to use logos. We reserve the right to rescind this permission if you violate these Terms of Service.
  2. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission by the Association for the Prevention of Torture.
  3. The materials contained in the Campus and Library may be freely quoted or used, including in your training, provided credit is given to the source (APT). Requests for permission to reproduce or translate the content should be addressed to the APT.
  4. You must not modify another website so as to falsely imply that it is associated with the Services or the Company.
Liability

You expressly understand and agree that the APT shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the APT has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Services; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to this Terms of Service or the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.

Email Communications
  1. By creating an account, which requires the submission of your email address to the Website, you consent to being included in APT’s Torture Prevention Village mailing list.You will receive emails from the Torture Prevention Village to your email address associated with your account, including website maintenance, developments and updates.
  2. You may remove your e-mail address from the e-mailing list at any time by clicking the “unsubscribe” link in any e-mail from the Torture Prevention Village. **Although the Torture Prevention Village will promptly remove your e-mail address from its mailing list, you may still receive any e-mails that are initiated before your e-mail address is removed from the list.
Content and online behaviour

The Virtual Café is meant for peer-to-peer learning, exchanges and feedback on issues related to the courses and or torture prevention in general. It is a public forum. It is not to be used to share irrelevant, offensive or inappropriate advertising, promotional or solicitation content.

By using the platform, you agree that you are responsible for all the content that you post on our platform. By all the content, this means all content submitted, posted, distributed or published on the Torture Prevention Village by you including on the virtual café and campus. You should keep the reviews, questions, posts, courses and other content you post or upload in line with our Terms of Service, Privacy Policy, your national as well as international law, and respect the intellectual property rights of others. You should respond or post in a polite manner and refrain from using or sending rude, abusive, inappropriate, harassing, derogatory or threatening words, pictures or messages on the platform.

The TPV administrators reserve the right to delete any content that does not comply with these Terms of Services. The TPV administrators reserve the discretion to ban your account for repeated or major offences. If you think someone has used offensive or derogatory words or is infringing your copyright or trademark rights on our platform, let us know by sending an email to tpv@apt.ch

You may not access or use the Services or create an account for unlawful purposes. Your use of the Services and behaviour on our platform must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.We may restrict or terminate your permission to use our platform and Services or ban your account at any time, with or without notice, for any or no reason, including for any violation of these Terms, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination we may delete your account and content, and we may prevent you from further access to the platforms and use of our Services. Your content may still be available on the platforms even if your account is terminated or suspended. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our platforms and services.

Any versions of this Terms of service in a language other than English are provided for your convenience. This is understood and agreed that and you understand and agree that the English language version prevails in case of conflict of interpretation will dominate if there is any conflict.
